1. Acceptance of Terms

By accessing or using ClearImpacts ("the Platform"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Platform.

These Terms and Conditions apply to all visitors, users, and others who access or use ClearImpacts. By accessing or using the Platform, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Platform.

2. Eligibility

ClearImpacts is intended solely for users who are at least 18 years of age or older. By using the Platform, you represent and warrant that you are 18 years of age or older.

We reserve the right to request proof of age at any time, and to suspend or terminate your account if we believe you are under the age of 18.

3. Account Registration

To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.

4. Virtual Currency and Credits

ClearImpacts operates as a free-to-play social casino and does not offer real money gambling. All virtual currency, coins, credits, or tokens ("Virtual Currency") used on the Platform:

• Have no real-world monetary value
• Cannot be exchanged for real money, goods, or services
• Are non-transferable and non-refundable
• May be altered, modified, or removed at any time at our sole discretion

You acknowledge that the Virtual Currency is not a real currency and that no monetary value is attached to the Virtual Currency. You agree that you have no ownership or property rights in or to any Virtual Currency.

5. Prohibited Uses

You agree not to use the Platform:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To exploit the Platform for any commercial purpose
• To attempt to circumvent any security measures or features of the Platform
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Platform
• To use any robot, spider, or other automatic device to access the Platform
• To introduce any viruses, trojan horses, worms, or other malicious code

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform.

7. Data Protection and Privacy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you.

By using the Platform, you consent to our collection and use of personal data as outlined in our Privacy Policy.

8. User Content

Our Platform may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post to the Platform, including its legality, reliability, and appropriateness.

By posting User Content to the Platform, you grant us the right and license to use, modify, perform, display, reproduce, and distribute such material on and through the Platform. You retain any and all rights to any User Content you submit, post, or display on or through the Platform.

You represent and warrant that: (i) the User Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content on or through the Platform does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

9. Intellectual Property

The Platform and its original content (excluding User Content provided by users), features, and functionality are and will remain the exclusive property of ClearImpacts and its licensors.

The Platform is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ClearImpacts.

You acknowledge and agree that all content, designs, graphics, logos, and other material provided on the Platform is the intellectual property of ClearImpacts or its licensors and is protected by intellectual property laws.

10. Cookies and Tracking

We use cookies and similar tracking technologies to track the activity on our Platform and hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Platform. For more information about the cookies we use, please see our Cookie Policy.

11. Disclaimer

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. ClearImpacts makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, ClearImpacts does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Platform or otherwise relating to such materials or on any sites linked to the Platform.

Important: ClearImpacts is a social casino for entertainment purposes only. Success at social casino gaming has no implication for success at real money gambling.

12. Limitation of Liability

In no event shall ClearImpacts, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content

13. Indemnification

You agree to defend, indemnify, and hold harmless ClearImpacts, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Platform.
